GENERAL

Health Boost Junkie welcomes you, the undersigned customer, and provides its services subject to the following Terms of Service (“TOS”). These TOS may be updated at Health Boost Junkie’s discretion, and you will be notified via email. By logging into our system, you agree to abide by these Terms of Service.

 

DESCRIPTION OF PRODUCTS & SERVICE

Health Boost Junkie offers an innovative method for transmitting information through SMS text messages via an easy-to-use website known as the “Service.” By using the Service, you consent to receiving certain communications from Health Boost Junkie through email, such as service announcements and administrative messages, which are considered part of your membership. Any new features that enhance the current Service will also be governed by the TOS. You acknowledge and accept that the Service is offered on an “AS-IS” basis. It is your responsibility to acquire access to the Service, which may entail additional costs (e.g., fees from your Internet service provider or airtime charges). You are accountable for covering these fees. Moreover, you are required to furnish and bear responsibility for all the equipment essential to access the Service.

 

HEALTH BOOST JUNKIE PRIVACY POLICY

To set up your account, you must provide Health Boost Junkie with specific information. Rest assured that Health Boost Junkie will never release your information to anyone without your prior approval, except when required by law. As part of its service, Health Boost Junkie collects the phone numbers of prospective members who access information via SMS but guarantees that these phone numbers will never be shared.

 

MEMBER ACCOUNT, PASSWORD AND SECURITY

Upon completing the registration process, you will receive a password and account designation. It is your responsibility to maintain the confidentiality of your password and account, and you are fully liable for all activities that occur under your account. Notify Health Boost Junkie immediately of any unauthorized use or breach of security, and make sure to log out after each session. Failure to comply with this may result in loss or damage for which Health Boost Junkie will not be held responsible.

 

MEMBER CONDUCT

You acknowledge that Health Boost Junkie may access, preserve, and disclose your account information and content if required by law or in good faith belief that it is necessary to comply with legal processes, enforce the TOS, respond to customer service requests, protect the rights and safety of Health Boost Junkie, its users, or the public, or respond to a legally issued subpoena or court order. The technical processing and transmission of the Service may involve network transmissions and changes to meet technical requirements.

 

You understand that the Service and its software may include security components protecting digital materials, subject to usage rules set by Health Boost Junkie. Attempting to override or circumvent these usage rules is strictly prohibited and may lead to unauthorized reproduction, publication, distribution, or exhibition of the materials provided by the Service.

 

INDEMNITY

You agree to defend, indemnify, and hold Health Boost Junkie, its officers, agents, and employees harmless from any claim, complaint, demand, or lawsuit, including reasonable attorneys’ fees, arising from your subscription or use of Health Boost Junkie services.

 

NO RESALE OF SERVICE

The Health Boost Junkie service is non-transferable. You may not reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the Service, its usage, or access for commercial purposes.

 

MODIFICATIONS TO SERVICE

Health Boost Junkie reserves the right to modify or discontinue the Service, either temporarily or permanently, with or without notice.

 

TERMINATION

Health Boost Junkie may terminate your account and access to the Service under certain circumstances without prior notice. Reasons for termination include breaches or violations of the TOS, requests from law enforcement or government agencies, self-initiated account deletions, discontinuance or material modification of the Service, unexpected technical or security issues, or engagement in fraudulent or illegal activities. Health Boost Junkie holds sole discretion in making termination decisions and will not be liable for such actions.

 

HEALTH BOOST JUNKIE PROPRIETARY RIGHTS

The Service and its software contain proprietary and confidential information protected by applicable intellectual property and other laws. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Service or Software without express authorization from Health Boost Junkie.

 

DISCLAIMER OF WARRANTIES

You acknowledge that your use of the Service is at your sole risk. Health Boost Junkie provides the Service on an “AS IS” and “AS AVAILABLE” basis. Health Boost Junkie expressly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Health Boost Junkie makes no warranty that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the Service will be accurate or reliable. Furthermore, any advice or information obtained from Health Boost Junkie or through the Service does not create any warranty not expressly stated in the TOS. Additionally, Health Boost Junkie warns that certain users may experience epileptic seizures or symptoms when exposed to specific light patterns or backgrounds while using the Service, and advises those with epilepsy or related conditions to consult a physician before using the Service.

 

LIMITATION OF LIABILITY

Health Boost Junkie shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to goodwill, use, data, or other intangible losses, arising from your use of the Service or any goods, data, information, or services obtained through the Service. Some jurisdictions may not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so some of these limitations may not apply to you.

 

EXCLUSIONS AND LIMITATIONS

Some jurisdictions do not permit the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Therefore, some of the above limitations may not apply to you.

 

NOTICE

Health Boost Junkie may provide you with notices, including changes to the TOS, via email, regular mail, or postings on the Service.

 

TRADEMARK INFORMATION

Health Boost Junkie’s logo, trademarks, and service marks are the property of Health Boost Junkie and are protected by intellectual property laws. You are granted permission to use Health Boost Junkie Marks in advertising brochures, sign riders, and other marketing campaigns.

 

GENERAL INFORMATION

The TOS constitute the entire agreement between you and Health Boost Junkie, superseding any prior agreements, and govern your use of the Service. The TOS and the relationship between you and Health Boost Junkie are governed by the laws of the State of Washington, and any disputes will be subject to the personal and exclusive jurisdiction of the courts located within the State of Washington. Failure to exercise or enforce any right or provision of the TOS does not constitute a waiver of that right or provision. If any provision of the TOS is found invalid, the parties agree that the court should attempt to give effect to the parties’ intentions as reflected in the provision, while the other provisions remain in full force and effect. Your Health Boost Junkie account is non-transferable, and upon your death, your account and its contents will be permanently deleted. Any claim or cause of action arising from the use of the Service or TOS must be filed within one year after the claim or cause of action arose.
